1. SCOPE.

1.1. These general terms and conditions of sale, drafted in accordance with current consumer protection regulations (d.lgs. Of 6.9.2005, no. 206 “Consumer Code,” with particular reference to Title III “Contractual Arrangements,” Chapter II “Particular Methods of Concluding Contracts,” Section II “Distance Contracts”; Legislative Decree. 9.4.2003, n. 70 “Implementation of Directive (EC) No. 31/2000 on Electronic Commerce”; Legislative Decree. 31.3.1998, n. 114 “Reform of the discipline relating to Commerce”) govern all purchase contracts having as their object the products in the online catalog of the Italian version of the website WWW.STAIBENECOSMETICA.COM concluded in the manner described herein.

1.2. The Customer declares that he/she has read all the information provided to him/her during the purchase procedure, that he/she fully and unconditionally accepts these General Terms and Conditions of Sale as well as the Conditions of Use of the site.

1.3. These general conditions may be changed by STAI BENE COSMETICA, without prior notice.

1.4. Each contract will be governed by the General Terms and Conditions of Sale in effect at the time the Customer submits the order.

2. IDENTITY OF THE SELLER.

2.1. Seller of the products in the online catalog of the Italian version of the website WWW.STAIBENECOSMETICA.COM is COSMETICAL PROJECT S.R.L a socio unico with registered office in Via della Pace, 2f3 40010 Sala Bolognese (Bologna) – Italy P.IVA. 03414421200

3. CONCLUSION OF THE PURCHASE CONTRACT.

3.1 To place your purchase order, you must first register as a Customer at the website WWW.STAIBENECOSMETICA.COM , and follow the purchase procedure indicated by the STAI BENE COSMETICA system .

3.2. The purchase contract entered into between STAI BENE COSMETICA and the Customer shall be considered concluded with the acceptance, even partial, of the Customer’s order by STAI BENE COSMETICA . Acceptance is expressed by a confirmation e-mail sent to the e-mail address provided by the Customer.

3.3. The confirmation message will include the date of the order and a ‘Customer Order Number’, to be used for any further communication with WWW.STAIBENECOSMETICA.COM. The message repeats all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections no later than 24 hours after placing the order. Any charges resulting from address entry errors and/or miscommunication will be borne entirely by the customer.

3.4. The Customer, having concluded the online purchase procedure, will check the accuracy of the data entered, print or save an electronic copy of their order and its confirmation and in any case to keep the current General Conditions of Sale.

4. OBJECT OF THE CONTRACT AND ONLINE CATALOG.

4.1. Item of these General Conditions of Sale are the products in the online catalog of the Italian version of the website WWW.STAIBENECOSMETICA.COM

4.2. The Customer may purchase only those products present and available in that catalog at the time of placing the order. STAI BENE COSMETICA reserves the right to change, without prior notice, the product catalog.

4.3. If prices or other details about products/promotions were displayed incorrectly, including because they were entered incorrectly in the database, we assume the right to cancel the shipment and inform the customer as soon as possible if the product has not yet been delivered.

4.4. If any of the requested products are no longer available, STAI BENE COSMETICA undertakes to contact the Customer within 30 working days from the time of placing the order, communicating by e-mail or telephone the possible unavailability and potential alternative solutions. In this case, the Customer may choose whether to wait for the delivery of the order if STAI BENE COSMETICA deems, in its sole discretion, to be able to find the unavailable product anyway, or to opt for another product, to which the relevant prices and tariffs will be applied, or to cancel the order obtaining a refund of any price already paid.

4.5. All products offered for sale are analytically described (quality, characteristics, price) in the special online catalog of the Italian version of the website WWW.STAIBENECOSMETICA.COM. The sheet of each product shows the retail price, including VAT. Additional and possible additional costs (shipping, transaction, administrative, and/or installation and/or insurance fees for the goods) will be displayed in total before the order is placed.

4.6. The image, which may be present accompanying the product description sheet, has a merely descriptive value and may not coincide with the actual characteristics of the good, but differ in color, size, accessory products in the picture. The color of the item may be different from that represented by your computer monitor also due to the particular calibration configured by the PC user.

4.7. Not all products may be supplied with an Italian language manual: the buyer agrees that the manual may also be supplied in a different language.

4.8. Some products may only be supplied with a so-called German electrical socket (i.e., 2-pole with side ground contacts).

4.9 The order can be cancelled at any time if it has not been confirmed by an operator of STAI BENE COSMETICA . If the Customer wishes to cancel the order after being confirmed by an operator, during or after delivery, the delivery and return costs will be borne by the Customer. 5. PAYMENT

Credit Card Payment

5.1 Payment for Products purchased on the WWW.STAIBENECOSMETICA.COM Site may be made by credit card directly through the Site. All credit cards belonging to the Visa and Mastercard circuits are accepted.
In order to ensure the security of payments made on the Site and to prevent possible fraud, STAI BENE COSMETICA reserves the right to ask the user, by e-mail or through the restricted area, for additional information and/or a copy of the identity document. The document must be valid. Pending the required document, the order will be suspended. In the absence of the required documentation, STAI BENE COSMETICA reserves the right not to accept the order.

All credit cards belonging to the Visa and Mastercard circuits are accepted.

In case of cancellation of the order, either by the Customer or in case of non-acceptance by STAI BENE COSMETICA, it will simultaneously request the cancellation of the transaction and the release of the committed amount. Order cancellation is possible up to the time the order is in the “Placed” condition and only if timely notice is given of the desire to cancel the order. The order status is clearly visible in the “Customer Area – Order Status” section.

Release times, for some types of cards, depend solely on the banking system and can extend to their natural expiration date. Having requested the cancellation of the transaction, under no circumstances can STAI BENE COSMETICA be held liable for any damages, direct or indirect, caused by delay in the failure of the banking system to release the committed amount.

At no time during the purchase process is STAI BENE COSMETICA able to know the buyer’s credit card information, as it is typed directly on the site of the banking institution handling the transaction (with very high security systems – SSL Secure Socket Layer Certificate); thus, there is no possibility of this data being intercepted. No computer file of STAI BENE COSMETICA contains, nor does it store, such data. Under no circumstances, therefore, can STAI BENE COSMETICA be held responsible for any fraudulent and improper use of credit cards by third parties when paying for products purchased on https://WWW.STAIBENECOSMETICA.COM.

Payment by Bank Transfer

5.2 In the case of payment by Advance Bank Transfer, what is ordered by the Customer

Payment by PayPal

5.3 In case of purchase through the PayPal payment method, upon completion of the order the Customer is directed to the PayPal login page. The amount related to the order is debited from the PayPal account when the order is taken. In case of cancellation of the order, either by the Customer or in case of non-acceptance by STAI BENE COSMETICA, the amount will be refunded to the customer’s PayPal account. Order cancellation is possible as long as the order is not yet in stock preparation. The status of the order is clearly visible in the “Order Status” area. Upon requesting the cancellation of the transaction, under no circumstances can STAI BENE COSMETICA be held liable for any damages, direct or indirect, caused by PayPal’s delay in not releasing the committed amount. At no time during the purchase process is STAI BENE COSMETICA able to know the Customer’s financial information. Since there is no data transmission, there is no possibility of this data being intercepted. No computer file of STAI BENE COSMETICA contains, nor does it store, such data. For each transaction performed with the PayPal account, the Customer will receive a confirmation email from PayPal.

5.4 STAI BENE COSMETICA reserves the right to suspend an order at any time for thorough checks if STAI BENE COSMETICA suspects attempted fraud.

5.5 STAI BENE COSMETICA may request identification documents if there is suspicion of fraud regarding the legitimacy of the client !

Such as: Copy of ID card, copy of Social Security number and/or first and last name from credit card and the last 4 digits written on the card that was used when ordering !

5.6 The customer has 30 days to prove his identity, otherwise the order will be canceled and the amount paid will be refunded.

6. INVOICE

6.1 For each order placed, STAI BENE COSMETICA will issue an invoice for the material shipped and the same will be transmitted only by email at the time the goods are entrusted to the courier. In the event that the order consists of multiple products and only some of the products are immediately available and ready for shipment, the order may be fulfilled in multiple partial shipments until all of the products in the order are shipped. In case of partial shipment, the total shipping cost of all products and the cash-on-delivery surcharge, if any, will be included in the first invoice. For the issuance of the invoice, the information provided by the Customer at the time of the order shall be binding. No changes in the invoice will be possible, after it has been issued. The Invoice should be kept carefully, representing the valid document for product warranty.

7. ORDER FULFILLMENT AND MODE OF TRANSPORTATION

7.1 The products purchased on the site can be delivered throughout Italy, including the islands according to the fulfillment schedules present at the time of the order within the individual product sheets, starting from the date of entry into processing of the order. Fulfillment timeframes start from the entry of the same into processing until the delivery of the goods to the courier. For delivery it will be necessary to wait for the courier time in continuation indicated.

7.2 All orders will be processed and shipped progressively according to the order number and only after the goods have been paid for, the timing of which depends on the payment method chosen. Orders paid by credit card, PayPal, cash on delivery will enter processing immediately, while orders placed by bank transfer and Agos financing, will enter processing only from the day of e-mail notification of payment by the administration. The times indicated for delivery are approximate and subject to change depending on the relevant courier and location and may still be subject to change due to force majeure, inconvenient traffic and road conditions, strikes or an act of the Authority.

7.3 Standard delivery, which provides for curbside delivery, is by courier and allows you to receive the goods at the address indicated in the order within the next 48 hours – 10 working days from the collection of the goods from our warehouses, which will be communicated by STAI BENE COSMETICA by means of an “Order Complete” e-mail. For islands, delivery takes place within 72 hours – 10 working days after the goods are picked up from our warehouses and “Order Complete” notification.

7.4 STAI BENE COSMETICA cannot be responsible for the consequences of any delay in delivery or loss or damage of the order by the courier. In the event that the order has not been delivered on time STAI BENE COSMETICA can, at the request of Customers, verify the causes of the delay. During this period (about 15 days), a refund or reshipment of the order will not be possible.

8. TRANSPORTATION INSURANCE AND LIABILITY

8.1 Pursuant to Art. 63 of the Consumer Code, the risk of loss of and damage to the goods, due to causes not attributable to the seller, is transferred to the consumer at the time when the consumer, or a third party designated by the consumer and other than the carrier, takes physical possession of the goods.

8.2 The Customer to enforce the carrier’s insurance coverage in the event that it finds anomalies at the time of delivery (damaged packaging or otherwise altered in the seals of closure, damaged or scratched product, lack of one or more packages ordered), must accept the product by writing on the document or on the PDA provided by the carrier: “YOU ACCEPT WITH SPECIFIC RESERVE” + description of the anomaly found. It is not sufficient, therefore, to note “YOU ACCEPT WITH RESERVATION” or “YOU ACCEPT WITH RESERVATION OF CHECK”, in a generic way, without specific reasons, BUT the reason for the reserve must be explained in detail, (eg, packaging slightly unpacked, strapping missing, broken Styrofoam, the presence of adhesive tape closing the courier, etc.).

8.3 The Customer shall also notify STAI BENE COSMETICA that he/she has accepted the product with specific reservation, indicating the anomaly found no later than 48 hours.

8.4 Should the package or product show visible damage, scratches, or any other type of abnormality and the courier refuses to have the specific reserve affixed, the goods must be rejected and the STAI BENE COSMETICA customer service department must be notified of what has happened in a timely manner at the email address info@staibenecosmetica.com

8.5 In any case, subject to the provisions of the Consumer Code Articles 128 et seq. , STAI BENE COSMETICA will not be held responsible for any anomalies found on the state of the product, after delivery, if the Customer, in the presence of an anomaly, has accepted the package without affixing a specific reserve (in the correct manner indicated above).

8.6 Once the Courier’s transport document has been signed without indicating the above, the Customer may no longer make any objection as to quantity and
Quality of what was received.

9. TIME OF RECEIPT OF THE PRODUCT WITH THE COURIER STILL PRESENT

9.1 The Client is recommended to:

  • In the case of appliances, verify that they are delivered vertically;
  • Verify that the product arrived matches what was ordered and on the invoice by checking it and checking the reference codes;
  • Verify the quantity of packages indicated on the bulletin;
  • Verify that the neck is perfectly intact in all its parts in the smallest details;

In order to enforce the carrier’s insurance coverage, report the slightest anomalies in the packaging with the wordING I ACCEPT GOODS WITH SPECIFIC RESERVE OF CHECK INDICATING THE DESCRIPTION OF THE ANOMALY NOTED.
E.g., PACKING NOT INTEGRATED or REGRET NOT PRESENT or PART OF POLYSTYRENE BROKEN. This should be noted on the courier’s palmarine, if any, and on the paper;

In the event that the package has a visual breakage, on the delivery note or on the PDA that will be signed, the Customer must write: I accept goods subject to checking SPECIFIC cause (e.g., unconditioned package, or other) or will have to refuse the delivery;

In the event that the courier refuses to have such specific reserves inserted, the Customer must reject the material and promptly give notice of the event by writing to info@staibenecosmetica.com , as in the absence of such wording STAI BENE COSMETICA will not be able to intervene in any way in the possible management of damaged packages, or missing pieces;

To be certain of the insertion of the wordING I ACCEPT GOODS WITH SPECIFIC CONTROL RESERVE(WITH REASON) the Customer will have to insert it PERSONALLY on the courier’s palmarino (by pressing send after insertion) and on the paper if present. THE COURIER WILL NOT INSERT SUCH WORDING FOR YOU !!!!

9.2 The specific indication of the reservation is of paramount importance to enforce the insurance of the transportation of products. In fact, shipments travel insured. At the moment STAI BENE COSMETICA entrusts the courier with the products, perfectly intact, an integrity check is carried out by the same, which in case of anomalies will not pick up the package. The specific reservation allows you to claim all or part of the damage from the carrier. Without the SPECIFIC reservation and an indication of the anomaly found, the Customer will be fully responsible for receiving an undamaged package that has no breakage or anomaly.

9.3 The reporting of any anomalies already reported with the specific reservation to the
courier, it must be received by STAI BENE COSMETICA no later than 48 hours. If the
report received after the specified time (48 hours after receipt of the
goods) no complaints of any kind will be accepted.

10. RIGHT OF WITHDRAWAL

10.1 Pursuant to Art. 64 et seq. of Leg. n. 206/2005, if the Customer is a private consumer (i.e., a natural person purchasing the goods for purposes not related to his or her professional activity, i.e., not making the purchase by indicating a VAT reference), he or she has the right to withdraw from the purchase contract for any reason whatsoever, without prejudice to what is indicated later, within the term of 14 days from the date of receipt of the products.

10.2 The right of withdrawal shall be exercised by sending, within the terms provided above (14 calendar days), an explicit statement from which the intention to exercise this right may be inferred (e.g. a registered letter with return receipt addressed to the Registered Office of COSMETICAL PROJECT S.R.L Via della Pace, 2f3 40010 Sala Bolognese (Bologna) – Italy P.IVA. 03414421200, possibly in advance by fax to 051829998 or e-mail to info@staibenecosmetica.com or PEC cosmeticalproject@pec.postatecnolaser.it) or by filling out the appropriate online form from this link.

10.3 The notice shall be deemed to have been sent on time if it is sent/delivered to the accepting post office within the above time limit.

10.4 In case of exercising the right of withdrawal the Customer, is required to return the purchased product to STAI BENE COSMETICA , at COSMETICAL PROJECT S.R.L Via della Pace, 2f3 40010 Sala Bolognese (Bologna) – Italy P.IVA. 03414421200, VAT No.: 03641221209, only after receiving return authorization by email or fax. This notice will contain all the information necessary to facilitate the proper return of the goods, including the address to which the goods should be delivered.

10.5 The substantial integrity of the property and its packaging and the absence of opening practices anomaly of the packages to be returned is an essential condition for the exercise of the right of withdrawal.

10.6 Products without return authorization will be returned to sender.

10.7 The product must be returned in respect of resale (undamaged and complete with original packaging).

For the proper exercise of the right of withdrawal by the Customer, please note that:

The Customer shall be liable only for diminution in the value of the goods resulting from handling the product other than what is necessary to establish the nature, characteristics and operation of the product. However, the product must be stored, handled and inspected with normal diligence and returned intact, complete in all its parts, fully functional, accompanied by all accessories and instruction sheets, with the identification tags, labels and disposable seal, where present, still attached to the product and intact and not tampered with, as well as perfectly suitable for its intended use and free of signs of wear or dirt. You can exercise the right of withdrawal in relation to the product in its entirety and not for parts and/or accessories of it. In the event that the serial code of the product is included on the packaging of the product, such as, for example, for electronics products, it constitutes part of the product and, consequently, the product must be returned in the original packaging, which must in turn be placed in an additional packaging, not being able to affix any other label or tape on the original packaging;

STAI BENE COSMETICA reserves the right to inspect returned merchandise to assess any damage or tampering resulting or not resulting from transportation.

The direct costs of returning the goods, as well as shipping and transportation responsibility (damage caused by the courier and/or others) will be borne and paid by the Customer.

The Customer must return the product without undue delay and in any case within fourteen days from the date on which he communicated his decision to withdraw from the contract. The deadline is met if the Customer returns the goods before the expiration of the fourteen-day period.

10.8 Reimbursement covers the amounts paid for the price of the product only.

10.9 In the event of forfeiture of this right, even if the package is received at the warehouses authorized by STAI BENE COSMETICA , the product will continue to be the property of the Customer, who must arrange for its withdrawal by courier. In the latter case, the cost of returning the goods to the sender/purchaser shall be borne by the Customer. After an additional 30 days, STAI BENE COSMETICA is no longer responsible for the product in its warehouses.

11. APPLICABLE LAW AND PLACE OF JURISDICTION

11.1 The sales contract between the Customer and STAI BENE COSMETICA is concluded in Italy and governed by Italian Law.

11.2 Without prejudice to the possible applicability of mandatory provisions of the law placed to protect consumers (as defined under Article 1 letter b) of Legislative Decree 22 May 1999 no. 185), any dispute in any way connected with these General Conditions, and therefore relating to the stipulation, interpretation, execution and termination of this contract, shall be devolved to the exclusive jurisdiction of the Court of Bologna.

11.3 Pursuant to and in accordance with Articles 1341 and 1342 of the Civil Code, the Customer declares that he/she has carefully read and understood and specifically accepts all the clauses of the General Terms and Conditions of Sale of WWW.STAIBENECOSMETICA.COM

11.4 The conditions contained herein may be changed by STAI BENE COSMETICA without prior notice and shall be valid from the date of publication on the website https://WWW.STAIBENECOSMETICA.COM
